Sales Consultant Independent Contractor Agreement

I acknowledge that I am working as an independent contractor with Retirement Prospects.

I will be responsible for the payment of all taxes from my income, and I understand that Retirement Prospects will not be responsible for taxes and is not withholding taxes from my earnings. 

Activity Standards

To be productive, I work hours that are most suitable for clients, but I choose my hours, and I work at my location. The company recommends that I work 8 am to 4 pm EASTERN TIME to make maximum sales.  I am provided a script, a video presentation and answers to frequent concerns. I use these materials to uphold company quality standards.  I will not state anything inaccurate or misleading. Calls are recorded for training and quality purposes.  I will receive feedback and agree to incorporate that feedback into future presentations.

I understand that the company incurs very significant marketing expenses to generate inbound requests from prospects.  Most of those requests will appear as appointments on my online acuity calendar.  I will not miss any of those appointments.  If I have an emergency and cannot keep an appointment, I will send notice immediately to [email protected]

Commissions

I will be paid $350 per completed sale.  A completed sale is

  1. ACCURATE completion of the order online at retirementprospects.com with me identified in the drop-down box as the salesperson. 
  2. The credit card of the client is successfully charged
  3. Receipt by Retirement Prospects of the signed agreements directly from the advisor (buyer) and account activated
  4. I schedule and provide the advisor a date and time for their initiation webinar

Commission payment is made every other Friday by Paypal or Zelle (preferred)  or another online service I designate.  Payment is on Friday for sales completed through the prior two weeks completed by Wednesday at 5 pm Pacific.  For example, for sales completed (see 4 conditions above for a completed sale) during the two-week period from Wednesday, March 28, 2018, at 5:01 pm to Wednesday, April 11, 2018, at 5 pm, commission is paid on Friday, April 13.

Very infrequently, management must cancel an advisor’s account and refund their payments. This is usually due to the financial advisor’s PC illiteracy, inability to navigate the Internet or have basic common sense.  These users are unable to use Retirement Prospects which is a web-based, automated, self-service system.  In these cases of refunds, a commission cannot be paid. The only other case is when the prospect requests a refund for any reason within 72 hours. We have situations as described in this paragraph maybe once per month (company-wide). The other way to lose a commission is if you get sloppy and you enter inaccurate data which causes the company to lose money on an account.

You may lose a commission if you enter inaccurate information when registering an advisor. 

Sales Etiquette

The company maintains a high standard of sales etiquette.  For example, if a member of the sales staff receives a call asking for another member of the sales staff by name, he will transfer the call and not “steal” the sale.  If I speak to an advisor and he calls the office to buy (rather than to my direct number), the company has no way of knowing if I have previously spoken to that prospect. Another member of the sales staff may close the sale and get credit.  Therefore, it is MY RESPONSIBILITY to have the advisor call ME at my number. If I don’t complete the sale (as evidenced by my name being selected on the online registration form), I won’t get paid. Best is to close on the first call, and I will never have a problem. The company will not arbitrate who gets paid a commission.  The rule—you close it, you earned it.

Required Results

I am expected to make at least one sale per day. By the end of 90 days, I am required to average is 2 sales/day.  If I cannot achieve these results, I understand the company will likely terminate this agreement.  The company will provide substantial learning resources and individual coaching to help achieve these results. However, I will need to apply myself and agree to complete the 9-week self-training program in Freshdesk.

If I am unable to take calls/respond to emails for any reason, I will notify the company with at least 48 hours prior notice.

Proprietary Information

Company agrees to provide to Contractor certain confidential and proprietary information. Contractor acknowledges that such confidential and proprietary information and materials (collectively referred to as "Confidential Information"), includes, but is not limited to, information regarding the general business operations, proposals, Contractor lists, database of clients and prospects ( including contact information and buying/prospecting histories), marketing strategies, financial information, plans, regardless of whether such information or materials are expressly identified as confidential or proprietary.

Contractor acknowledges that, regardless of whether such Confidential Information is prepared or generated by Contractor or Company, is provided to Contractor pursuant to this Agreement, or comes into the possession or knowledge of Contractor in some other fashion, such Confidential Information shall remain the exclusive confidential property of Company, except to the extent expressly authorized in writing by Company for dissemination. Contractor further acknowledges and agrees that all such Confidential Information constitutes trade secrets and/or valuable, proprietary information of Company as it is not generally known to the public.

During the term of this Agreement and for so long as the Confidential Information is not generally known to the public, Contractor shall not use or disclose any of such Confidential Information to any third party (except as authorized in the course of employment) without the prior written consent of Company and shall take all reasonable steps and actions necessary to maintain the confidentiality of such Confidential Information. Company database of prospects and clients is a most valuable asset and cannot be copied or used in any way except as a Contractor of Retirement Prospects. This also includes marketing and sales plans, trade secrets, procedures and methods used by Company that are not to be discussed with others.
